1. Who we are

Markham Realtor Rankings is operated by Ryan Chan. This is an independent consumer resource. It is not a brokerage and is not affiliated with any brokerage, board or association. We are not a brokerage, we do not trade in real estate and we are not a party to any transaction between you and an agent.

2. What this site is, and is not

This site is an information resource. Rankings are produced by the formula published on our methodology page using the data available to us. A ranking position is not a recommendation, not an endorsement, not a guarantee of service quality and not a statement that one agent is better suited to you than another.

Nothing on this site is legal, financial, tax or real estate advice. You are responsible for your own due diligence, including confirming an agent registration on the public register maintained by the Real Estate Council of Ontario and interviewing more than one agent before you engage anyone.

3. Reviews

By submitting a review you agree that:

• you personally worked with the agent on the transaction you describe;
• you are not the agent, and are not connected to the agent, their brokerage or a competing agent;
• you have not been paid or given any incentive to submit the review;
• your review is your honest account and opinion;
• it complies with our review guidelines;
• you grant us a non exclusive, royalty free, worldwide licence to publish, reproduce and display it on this site, which you may end by asking us to withdraw the review.

We may decline to publish, or may remove, any review that breaches the guidelines, that we are legally required to remove, or that we reasonably believe to be fabricated or manipulated. We are not obliged to publish any submission.

Reviews are the views of the people who wrote them, not ours. We do not adopt or endorse them, and we do not verify the underlying facts of a transaction beyond the verification steps described in our guidelines.

4. Agent profiles and claims

Agents who claim a profile are responsible for the accuracy of what they submit, and warrant that they are currently registered with the Real Estate Council of Ontario and are the person named. We may suspend or remove a profile where information is inaccurate, where registration lapses or where these terms are breached.

Claiming a profile is free and does not confer any ranked position. Agents may respond publicly to reviews and may not delete them.

5. Rankings

Ranked position is generated by the published formula. No payment, advertising relationship or other commercial arrangement affects it. We may change the formula, and if we do, the change applies to all agents equally and the methodology page is updated to reflect it.

Any sponsored placement will be labelled Sponsored and shown separately from the ranked list.

6. Acceptable use

You must not:

• submit false, fabricated or incentivised reviews;
• coordinate review submission, or submit reviews from multiple accounts or addresses to influence a ranking;
• impersonate anyone, or claim a profile that is not yours;
• scrape, harvest or bulk download content from this site by automated means;
• use the site to send unsolicited commercial messages to anyone listed;
• interfere with the operation or security of the site;
• post content that is unlawful, defamatory, discriminatory or that discloses personal information about a third party without consent.

7. Intellectual property

The site design, written guides, methodology and compilation of content are owned by Ryan Chan. Reviews remain the property of the people who wrote them, licensed to us as set out above. Agent supplied profile content remains the property of the agent, licensed to us for display.

The trademarks REALTOR, REALTORS and the REALTOR logo are controlled by The Canadian Real Estate Association (CREA) and identify real estate professionals who are members of CREA.

8. Third party links

We link to external sites, including brokerage websites and regulatory resources. We do not control them and are not responsible for their content, accuracy or privacy practices.

9. Disclaimer and limitation of liability

The site is provided on an as is and as available basis. To the fullest extent permitted by law we exclude all warranties, express or implied, including as to accuracy, completeness, fitness for a particular purpose and uninterrupted availability.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or any loss of profit, revenue or opportunity, arising from your use of the site or from your dealings with any agent listed on it. Nothing in these terms excludes liability that cannot lawfully be excluded.

Your engagement of any real estate professional is a matter between you and them. We are not a party to it and bear no responsibility for it.

10. Disputes and takedowns

Agents who believe a review breaches the guidelines should use the dispute process. Legal and privacy takedown requests use the same page. We respond to every properly made request.

11. Changes

We may change these terms. The date at the top shows the most recent update, and continued use after a change means you accept the revised terms.

12. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it. The courts of Ontario have jurisdiction, subject to any consumer protection right you have to bring proceedings elsewhere.
